PRIVACY STATEMENT

Fresh Retailing Pty Ltd (trading as ‘Trampoline’) takes its obligations to your privacy very seriously and aims to adhere to the principles of the Privacy Act 1988.  The policy covers all personal information that we gather and retain including information collected in store,  our research, competition draws and that which was voluntarily given through franchising enquiries and our ‘Mates of Trampoline’ loyalty program.  Trampoline does not purchase information from third parties.

 

INFORMATION COLLECTION

Trampoline only collects information with the subject’s permission and acknowledgment.  We will always tell you what we intend to use your information for and where permission has been given may inform you about special promotions, new products and services and special offers.

 

Trampoline only collects customer information through marketing initiatives such as registering for competitions, signing up for franchising information at our site or sites where we advertise, or joining our ‘Mates of Trampoline’ Loyalty Program. The personal information we ask for is usually first and last name, store of preference, date of birth, email address, mobile phone number and some generic profile questions.

 

SECURITY OF INFORMATION

Trampoline endeavors to ensure that your personal information is kept secure.  We only allow access to your information by members of the Trampoline  Team and companies associated and involved in the administration of our competitions and communications relating to the ‘Mates of Trampoline’ Loyalty Program.  Where possible, Trampoline will take reasonable steps to:

 

(a)  protect the personal information it holds from misuse and loss and from unauthorized access, modification or disclosure; and

 

(b)  destroy or permanently de-identify personal information if it is no longer needed for any purpose

 

The personal information we collect from you may be disclosed to:

TRAMPOLINE GELATO'S ‘ENDLESS SUMMER’ COMPETITION

  • The Promoter is Fresh Retailing Pty Ltd (T/A Trampoline) of 182 Stawell Street, Burnley, VIC, 3127.
  • Entry into promotion deems acceptance of these Terms and Conditions.

 

1. YOUR ENTRY

  • Competition commences Thursday February 28 2013 at 9am (AEST), through to Sunday April 7 2013 at 12am (AEST).  Winners will be contacted by Monday April 15 2013 via phone/email and announced via Trampoline Gelato’s Facebook page, Twitter page and website.
  • To enter the major competition, entrants must complete an entry form and submit it instore. The entry form is comprised of the respondents personal information, plus an answer to the question ‘Apart from Summer, what else do you wish was endless..?’
  • To enter the minor competition, entrants must ‘Like’ Trampoline Gelato on Facebook for their chance to win.
  • Trampoline takes no responsibility for lost, late, incomplete, misdirected, damaged or destroyed entries.
  • All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Terms and Conditions may be disqualified.
  • Eligible Entrants may enter as many times as they like over the length of the competition.
  • The information you provide will only be used for internal purposes or matters relating to the competition.
  • By providing your details Trampoline may email you from time to time as part of our Mates program, however should you not enjoy these high quality e-coms, you'll always have the option to unsubscribe.
  • This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Trampoline and not to Facebook.

 

2. ELIGIBILITY

  • Entry is only open to Australian residents only.
  • Employees of The Promoter (fresh Retailing Pty Ltd) and their immediate families are ineligible to enter.
  • Entry is valid only if appropriate identification of the entrant themselves is provided.

 

3. THE PRIZE!

  • There are 3 major prizes available, each comprising of:
    • 1 x Vuly Bouncing Trampoline Pack, which includes 1 x 10ft Vuly Trampoline, 1 x 10ft Deluxe Trampoline Tent, 1 x 10ft Trampoline Skirt, 1 x Basketball Hoop, 1 x Anchor Kit, 1 x Ladder and transport costs up to $150 (Total RRP per pack approx. $1050).
  • The total prize pool for major prizes is valued at approx. RRP $3,150.
  • In the event that any prize item is unavailable, Trampoline reserves the right to substitute a prize item of equal or greater value. Except with the written consent of Trampoline, prizes are not transferable or exchangeable and cannot be taken as cash. Trampoline has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
  • Other than the prizes outlined in these terms and conditions, no further claim may be made against Trampoline making use of the submitted materials.

 

4. WINNING

  • The Promoter warrants that 'the Contest' is a game of skill and that chance plays no part in determining the winners.
  • The winners will be chosen by a panel of judges at Trampoline and will be those deemed as having the best creative answer to the question outlined on the entry form.
  • Winners will be announced by Monday April 15 2013 via Trampoline Gelato’s Facebook page, Twitter page and website.
  • Entrants, by entering this contest, agree to abide by these terms and conditions, and that the decisions of the Judges are final.
  • If prizes remain unclaimed within 30 days of notification, an alternative winner will be awarded the Prize.
  • Trampoline accepts no responsibility for loss or damage to prizes in transit. Trampoline makes no representations or warranties as to the quality/suitability of any of the goods/services offered as prizes. To the extent permitted by law, Trampoline is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by Trampoline, or its agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.

 

5. INTERNET USAGE

  • If for any reason the Internet entry portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Trampoline which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Trampoline may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.
  • Trampoline reserves the right, at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest.
  • Trampoline assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, the entries.
  • Trampoline is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Trampoline as a result of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to the entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.
  • In the event of a dispute, entries made by Internet will be declared made by the authorised account holder of the e-mail address submitted at time of entry. "Authorised account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organisation (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.

 

6. INFORMATION PROVIDED

  • Trampoline will collect personal information about those people entering the contest to ensure they are eligible to participate and so that Trampoline can administer the contest. Trampoline may disclose that personal information to organisations associated with the contest, subject to privacy laws. If an Entrant does not provide their personal information they cannot participate in the contest.
  • All entries become the property of Trampoline and the entrant assigns copyright of the entry to Trampoline. Trampoline has entry for all promotional uses or any other purposes. Therefore, Trampoline has perpetual, irrevocable, world-wide, free license to use, reproduce, adapt and communicate any material submitted as part of the contest.
  • In receiving the prize, the winners agree to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed.
  • It is the Entrant's responsibility to inform Trampoline of their residential address, email or phone number changes during the Contest Period.
  • By entering this Contest, the Entrant consents to the publication of their name and photographs on the web site should they win the Contest.
  • The Entrant warrants that any text submitted as part of the contest is their own, and that the entrant has the right to distribute the material. Trampoline reserves the right to remove any Entrants of the game if their submission is deemed to be offensive or inappropriate at its sole discretion.
  • Entrants can contact Trampoline if they wish to access the personal information that Trampoline holds about them.

 

7. DISCLAIMER

  • Trampoline reserves the right to withdraw, amend or terminate this Contest at any time without prior notice. Trampoline also reserves the right to cancel this contest at any time because of any printing or other error, or if either of them suspects or finds evidence of tampering with any part of the Contest. Trampoline shall not be liable for any errors or negligence that may arise or occur in connection with the Contest. Trampoline is not liable for injuries, death, damages or losses of any kind resulting from acceptance or use of the Prizes.
  • Trampoline reserves the right to seek damages to the fullest extent permitted by law. If Trampoline suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify The Trampoline for those losses, damages and costs.

 

8. ANNOUNCEMENT OF WINNERS

  • The winners' names will be announced by April 15 2013 via Facebook, Twitter and Trampoline Gelato website.

 

9. SUBJECT TO APPLICABLE LAWS

  • This Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.

TRAMPOLINE GELATO'S ‘ENDLESS SUMMER’ WIN 1 OF 10 FREE AFTER DINNER TINS WEEKLY

  • 10 free After Dinner Tins, valued at $28.90 will be distributed each Thursday during the five weeks of the competitions entry period (50 tins total).
  • Prizes will be received in the form of a softcopy voucher and will have minimum one month validity from the date with which they are distributed.
  • In order to be in the running for the weekly prizes, entrants must ‘like’ Trampoline Gelato through their Facebook Page. All ‘Likes’ will then be automatically entered into the weekly prize draw (ie. not just those who have ‘Liked’ the page from that week).
  • Vouchers can only be used once and are not valid with any other offer.  Multiple or photocopied vouchers will not be accepted.
  • Judge's decision is final and no correspondence will be entered into.
  • Vouchers are not transferable or redeemable for cash and can only be redeemed by the voucher holder.
  • Vouchers valid at any Trampoline store nationally.
  • The total prize pool for minor prizes is valued at RRP $1445.

Online Cake and Take Home Orders

Trampoline works hard to ensure that all online orders are hand made to exceed your expectations and that your cake is ready for you at your specified collection time.

 

To ensure that this is possible we require a minimum of 48 hours from the time your online order is submitted until your collection time.  If you need it quicker, please call our store and we’ll do everything in our power to make it happen!

 

The store will call you back in less than 24 hours, however if you have not heard from a member of our team, please ensure you contact the store to double check the order has been received…  The joy of electronic communication!
